1. How the programme works

This Referral Programme allows existing customers of Outcome Diagnostics Ltd (trading as Medicspot), who are subscribed to a Medicated or Non-Medicated Weight Loss Programme, to refer friends to join our services.

When a referred friend signs up and pays for their first full month, both the referrer and referred friend will receive a £20 discount as described below. Referrers and referred friends must be aged 18-75 and reside in the UK to participate.

Rewards relate solely to referring friends to Medicspot’s weight management service, not to any specific prescription treatment.

Participation is voluntary and not a condition of using Medicspot’s weight loss services.

2. MHRA and advertising compliance

Medicspot’s Referral Programme does not promote or advertise any prescription-only medicine (POM).

All referral communications must avoid mentioning, implying, or recommending specific POMs or their effects.

All language must be factual, non-promotional, and focused on the service experience.

Any communication implying the availability, efficacy, or safety of a specific POM is prohibited under the Human Medicines Regulations 2012 and MHRA Blue Guide.

3. Referral administration

This programme is administered through Referral Factory, a third-party referral platform that tracks and validates referrals.

A valid referral applies only to new patients joining a Medicated or Non Medicated Weight Loss Programme weight loss programme for the first time.

4. What counts as a referral

A referral is successful once the referred friend’s first month payment for a qualifying programme is completed, cleared, and not refunded or disputed.

At that point, rewards for both referrer and referred friend will be issued.

Medicspot may withhold or cancel rewards where fraudulent, duplicate, or self-referrals are suspected. Medicspot reserves the right to verify participant eligibility before issuing any reward.

5. Rewards and offers

Upon a successful referral, the following rewards are offered:

• Referrer Reward: The referrer will receive £20 off their next order.
• Referred Friend Reward: The referred friend will receive £20 off their first month subscription or Behavioural Change Course order.

The discount is only applicable when a new patient starts a full Medicated or Non Medicated Weight Loss Programme.

Rewards have no cash value and are non-transferable.

6. Issuing rewards

Rewards are issued within 30 days of the referred friend completing their qualifying purchase. To qualify for the reward, the referrer must be an active subscriber at the time the reward is issued. The referred friend must have completed their first month’s payment and continued into the second month of the subscription.

Rewards are tracked and processed through Referral Factory. All referrals must be verified by Referral Factory before the rewards are issued. If any discrepancies arise in the referral tracking, Medicspot reserves the right to withhold rewards until the referral is validated.

Medicspot’s decision on referral validity is final and binding to ensure fairness and prevent abuse.

7. Privacy

All personal information collected and processed as part of this Referral Programme will be used in accordance with Medicspot’s Privacy Policy. Under the applicable laws and regulations, Medicspot shall be responsible for collecting and processing such personal information.

Personal information collected must comply with privacy standards outlined in the Medicspot Privacy Policy and UK advertising guidelines. Information shared must not inadvertently promote POMs, adhering strictly to patient confidentiality and MHRA regulations.

By participating in this Referral Programme, you acknowledge that Medicspot shares necessary personal data with Referral Factory for the sole purpose of administering the programme (i.e. Name, Email). Referral Factory’s processing of this data is subject to their privacy policy and data protection standards.

You must comply with the UK Privacy and Electronic Communications Regulations (PECR) when contacting friends privately about the referral.

Referrers must only send invitations to individuals with whom they have a genuine personal relationship and who would reasonably expect to receive the message.

Medicspot does not authorise mass messaging, automated outreach, or public posting of referral links.

8. Referral communication guidelines

To ensure compliance with MHRA regulations, participants must use non-promotional and factual language when referring friends.

Referrers should use private, direct channels (e.g., personal emails, direct messaging) for all referral communications to minimise the risk of broad public promotion that could be considered advertising. Below are examples of compliant statements for different types of programmes:

• For Medicated Weight Loss Programmes:
  • “I’m part of a weight loss programme with Medicspot that has been working well for me. If you’re interested, I can share a referral link with you.”
  • “Medicspot offers a weight management service with medical consultations. Let me know if you want a referral link to check it out.”
• For Non Medicated Weight Loss Programmes:
  • “Medicspot has a comprehensive behavioural change course for weight management support. I can share a referral link if you’re interested.

Important note: Participants must avoid mentioning or implying specific POMs or making claims that promote any POMs. All referrals should focus on the service and general programme benefits without referencing specific medication names or their effects.

Important note: By sharing your referral link, you agree to only send it privately to friends and family members. Public sharing of your referral link (including posting on social media and forums) is strictly prohibited. Sharing your referral link publicly may result in immediate removal from the Referral Programme and forfeiture of any rewards.

9. Monitoring and enforcement

Medicspot reserves the right to monitor public platforms, including but not limited to social media sites, blogs, and forums, to ensure referral links are not shared publicly in violation of these Terms and Conditions.

If a referral link is found to have been shared publicly, Medicspot may request the participant to remove the content immediately. Failure to comply with this request may result in termination of participation in the Referral Programme, cancellation of pending rewards, and/or reclaiming of any previously issued rewards.

By participating in the Referral Programme, you agree to cooperate with Medicspot in any investigation related to improper public sharing of referral links.

Medicspot may also report non-compliant promotional activity to the MHRA or ASA if it constitutes advertising of POMs.

1o. Non-compliant communication examples

To remain compliant with MHRA regulations, participants must avoid using any language that could be considered promotional or imply the endorsement of specific prescription-only medicines (POMs). Below are examples of statements not to use when referring a friend:

• “Join Medicspot’s programme and get access to [specific medicine name] for weight loss.”
• “This programme prescribed me the best medication, and you can get it too!”
• “You should try Medicspot’s weight loss programme—they prescribe [mention of specific POM] that works wonders.”
• “With this referral, you can get the same powerful medicine I’m using for weight management.”
• “Sign up and get discounted treatment with [specific medicine], which really helped me lose weight quickly.”

Important note: Referrers must avoid making any mention of specific medications, their benefits, or implications that suggest guaranteed results. Referrals should focus on the overall service and experience without promoting or implying the use of specific POMs, as this contravenes UK advertising laws and MHRA guidelines.

Any communication implying access to or promotion of a specific POM constitutes a breach of MHRA advertising rules and may result in immediate termination of participation.

Medicspot reserves the right to suspend or report repeat violators to relevant regulators.

11. General

These Referral Terms are published by Medicspot (“we”, “us”, and “our”). Our Referral Programme as displayed on our Website www.medicspot.co.uk and these Terms form a binding agreement for both Referring Users (“you” or “your(s)”) and people who receive our referral invitation.

This Referral Programme permits you to invite your contacts to participate in one or more Referral Programme(s).

You may only invite personal friends, family members, acquaintances, and colleagues to this Referral Programme.

You must not invite individuals with whom you have no prior personal relationship.

Any digital representation of the programme must not use phrases or features like ‘Buy Now’ or icons that suggest direct purchasing of POMs.

Programme descriptions on websites and platforms should clearly indicate that all decisions regarding prescription and use of medicines are based on consultations with qualified healthcare professionals.

This programme relies on Referral Factory to manage referral tracking and validation. Any technical issues affecting Referral Factory’s system may impact the programme’s operation, and Medicspot shall not be held responsible for delays or disruptions caused by third-party software.

Medicspot will take reasonable steps to resolve technical failures but is not liable for loss of expected rewards due to third-party errors.

12. Limits and eligibility

A Completed Referral is when a Referring User refers this Programme to one of its contacts, leading to a purchase as defined above.

Each Referring User may refer up to 7 friends.

All referred people must be new and first-time Users. Existing Users cannot participate in and benefit from the Referral Programme.

You represent all personal information is 100% correct and up to date. We may monitor your use of the Referral Programme or request your ID to verify your identity before issuing rewards.

Only new patients enrolling in a full Medicated or Non Medicated Weight Loss Programme are eligible for referral rewards.

Rewards are limited to one per referred friend.

13. Restrictions

This Programme cannot be combined with other Medicspot’s referral programmes, discounts, vouchers, benefits, or incentives. By participating in this Referral Programme, we may restrict you from any other promotion, programme, discount, or vouchers.

Participants must ensure that their referral communications comply with anti-Spam legislation and avoid any reference to specific POMs to prevent contravening advertising laws related to POMs.

You understand and agree that you must not use referral methods that are bothersome to the recipients. Moreover, your participation in the Referral Programme must not violate the applicable law, including but not limited to anti-Spam legislation, which involves the mass distribution of unsolicited messages.

Publishing or promoting this programme on platforms that reference adult content, alcohol, tobacco, gambling, or unregulated health claims related to POMs is strictly prohibited.

You must not at any time, invite or refer people who are unknown to you.

You must only use our Referral Programme for personal use and refrain from its use for commercial purposes.

Medicspot reserves the right to remove participants engaged in bulk or incentivised referral practices.

14. Termination

We may terminate this Referral Programme at any time, including your participation or the availability of its benefits.

If Referral Factory ceases to provide its referral tracking services, Medicspot may, at its discretion, terminate or modify the Referral Programme accordingly. Participants will be notified in such an event.

15. Relationship

You understand and agree that you are only the User of our services and/or products, and refrain from implying any other affiliation or legal relationship with us.

You understand and agree that you are never authorised to legally bind our company.

You must never create any materials that contain our branding, trademark, (part of) our corporate identity.

By participating in the Referral Programme you must not represent yourself as a duplicate, agent, or intermediary of our company.

16. Amendments

We may amend the terms and conditions of our Referral Programme. We may offer and/or restrict additional incentives, benefits, and programmes. As a result, additional terms may apply. You agree that you are aware of those amended and additional terms.

Any changes made to the Referral Programme due to modifications in Referral Factory’s service offerings, tracking capabilities, or data policies will be communicated to participants in advance.

17. Violations

Sharing your referral link publicly, including posting it on social media and public forums, constitutes a material breach of these Terms and may lead to suspension, removal from the Referral Programme, cancellation of rewards, and potential recovery of rewards already issued.

In case we suspect any violations of these terms or otherwise tampering with, fraud, or unreasonable use of our Referral Programme, we may in our sole discretion cancel the distribution of any discount, benefit, or payout.

If you are a current or former employee, contractor, or affiliate of our company, we may restrict your participation in the Referral Programme, and we may restrict or cancel your participation with immediate effect.

You must comply with all applicable laws and regulations, and refrain from violating any third-party rights. These rights include any copyright, trademark, or other proprietary rights.

Any claim that implies or highlights benefits specific to POMs as part of the referral programme will be considered a violation and grounds for termination of participation.

Medicspot reserves the right to report egregious breaches to relevant authorities.

18. Disclaimer and Indemnification

We offer our Referral Programme and its benefits only on an “as is” and “as available” basis. We may remove, change, and update the Referral Programme in our sole discretion. We will never make any promises or guarantees about the content and information of our Referral Programme. We disclaim our responsibility for any information that is incorrect or has errors.

Our Referral Programme is based on our best efforts. You acknowledge and agree that we can never guarantee any benefit or result from participating in the Referral Programme.

You will defend, indemnify, and hold Medicspot harmless from and against all claims, damages, liabilities, losses, expenses, and costs (including reasonable legal fees) arising out of your participation in the Referral Programme.

Medicspot is not liable for any errors, omissions, or disruptions caused by Referral Factory, including but not limited to delays in reward issuance, referral tracking failures, or technical system errors.

19. Correspondence and complaints

With regards to the distribution of discounts, vouchers, incentives, prizes, awards, or other benefits, no correspondence will be entered into. Moreover, we shall never respond to any complaint or accept any dispute about the Referral Programme, and the above mentioned benefits are provided “as is” and we never refund or exchange such benefits.

No correspondence regarding the distribution of incentives that implies the promotion of POMs will be entertained. All claims regarding POM-related issues must be addressed with strict adherence to MHRA guidance.

20. Governing law

The laws of England and Wales shall apply and the courts of England and Wales are competent to hear any claim that may arise out of these terms.
